Year in review, #3: Louisburg presses ahead in its quest for water PDF Print E-mail

The city of Louisburg came out victorious in a yearlong battle with Miami County Rural Water District No. 2 over the amount Louisburg needed to pay for the reasonable value of property, facilities and improvements located on more than 1,800 acres of annexed land in question in the suit.

In March 2007, a three-member appraisers’ panel ruled Louisburg needed to pay $133,200 to RWD No. 2, but RWD No. 2 appealed that decision, leaving District Judge Richard M. Smith to make a ruling on the case. RWD No. 2 was asking for between $8 million and $12 million for the loss of future customers.

Smith ended up upholding the ruling, saying RWD No. 2 failed to prove the appraisers’ findings were unreasonable and provided a detailed guideline for cities and rural water districts across the state to see how the court system likely will interpret the laws surrounding city annexations in rural water district territory.

Paola and Louisburg continued to make progress on their joint more-than-$30 million project that includes the construction of a water treatment plant southeast of Paola and new water towers to serve both cities. The water plant is scheduled to go online next summer.

The Marais des Cygnes Public Utility Authority, which currently is composed of Paola and Louisburg but may add other entities in the future, has been managing the ongoing water project.

Once online, the plant will be able to provide water to Paola and Louisburg, as well as wholesale customers.

Louisburg and Paola water plant operators have agreed to help operate the new plant next year.

You know, I hope with the new water plant that Louisburg will stop being non-compliant by EPA standards. I don't know how a town can be non-compliant for years and the government won't step in.
